These Terms of Service ("Terms") are a legal agreement between you and [COMPANY LEGAL NAME] ("Riyo," "we," "us," or "our"), governing your access to and use of the Riyo website, applications, and related services (collectively, the "Service"). By creating an account, verifying your age, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

1.1 You must be at least 18 years old to create an account or use the Service. Riyo is not directed at, and must not be used by, anyone under 18, regardless of local age of majority.

1.2 By using the Service, you represent and warrant that:

You are at least 18 years old;
You have the legal capacity to enter into these Terms;
You are not barred from using the Service under the laws of your jurisdiction or any applicable export control laws;
All information you provide (including your date of birth) is accurate.

1.3 Before you can chat, we run an age check. You take a short selfie on a page run by a specialist age-assurance provider (currently Didit), which estimates whether you are 18 or older; we keep only the result. Depending on how the Service is set up, we may also ask you to state your date of birth. If the check indicates you are under 18, or you cannot complete it, we may block access from your device. Providing false information, using someone else's face or ID, or otherwise trying to bypass this step is a violation of these Terms and may be reported where legally required.

1.4 We may, at our sole discretion, refuse service, suspend, or terminate accounts of anyone we reasonably believe is under 18 or has misrepresented their age.

2. The Service

2.1 Riyo connects users for random one-on-one (and, where offered, group) video, voice, and text conversations with other users. Matching is anonymous by default; we do not guarantee who you will be matched with, the content of any conversation, or the behavior of any other user.

2.2 The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted, error-free, or secure operation.

2.3 We may modify, suspend, or discontinue any part of the Service, including specific features (filters, translation, group rooms, mini-games), at any time, with or without notice.

3. Accounts and Devices

3.1 Some features require a registered account (email/password or another supported sign-in method). You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

3.2 Certain safety and matching features (blocking, reporting, ban enforcement) are tied to a device identifier stored in your browser and to a device fingerprint (a hash of technical characteristics of your browser and device), independent of whether you have an account. Clearing your browser storage or using a different browser may reset the identifier, but we may use the fingerprint, account status, and payment information to enforce bans and blocks across such resets. You agree not to try to defeat these measures.

3.3 You agree to notify us promptly of any unauthorized use of your account.

3.4 Plus and Premium members provide their gender, age (which must be at least 18), and main language, and may set matching preferences. You agree to provide accurate information. These details are self-declared and not verified by us, and we do not guarantee that other users' details are accurate. Matching filters are preferences, not guarantees. Your country is detected automatically from your connection, may be inaccurate (for example if you use a VPN), and is shown to the person you are matched with. Providing false details, including a false age, is a violation of these Terms.

3.5 One place at a time. You may chat from one window or device at a time per device, and from at most two devices per account at once. Starting a chat in a new window pauses the older one. Do not share, lend or sell your account or your paid plan, or let other people use it; we may suspend accounts that are shared or resold.

4. Prohibited Conduct

You agree that you will not, while using the Service:

4.1 Involve minors. Use the Service if you are under 18; attempt to contact, solicit, groom, or exploit anyone you believe or have reason to believe is under 18; or share, request, or facilitate the sharing of child sexual abuse material (CSAM) in any form. If we become aware of a violation of this section, we will end the session, ban the device, and, where we are able to and where the law requires, report it to the relevant child-protection or law-enforcement authorities and cooperate with them.

4.2 Expose others to sexual content without consent. Broadcast, display, or transmit nudity, sexually explicit conduct, or sexual solicitation, including to a partner who has not consented to it (also known as "flashing").

4.3 Harass, threaten, or abuse other users, including through hate speech, discrimination, targeted harassment, threats of violence, or incitement to harm based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, or age.

4.4 Engage in illegal activity, including but not limited to promoting or facilitating drug sales, weapons sales, human trafficking, fraud, or terrorism/extremism.

4.5 Record, capture, screenshot, or redistribute another user's video, audio, image, or likeness from a session without their explicit consent.

4.6 Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

4.7 Circumvent or interfere with the Service, including by attempting to bypass age verification, content moderation, matching restrictions, bans (for example by clearing browser data, switching browsers, devices, or networks, or creating new accounts to return after a ban), or rate limits; using bots, scripts, or automated tools to interact with the Service; or reverse-engineering, scraping, or attempting to access non-public parts of the Service.

4.8 Solicit payment, advertise, or promote another business or service to other users without our prior written consent.

4.9 Upload or transmit malicious code, or otherwise attempt to compromise the security or integrity of the Service.

4.10 Violate any applicable local, state, national, or international law.

5. Content Moderation and Enforcement

5.1 We use a combination of automated systems and human review to detect and act on violations of these Terms, including:

Automated scanning of sampled video frames for nudity and explicit content;
Automated scanning of chat messages for profanity, harassment, sexual content, and other prohibited categories;
User-submitted reports.

5.2 Automated moderation is not perfect. It may fail to catch some violations and may occasionally flag content incorrectly. We reserve the right to take enforcement action based on automated detection alone, without prior human review, particularly where content or conduct appears to pose an immediate safety risk.

5.3 If we determine, in our sole discretion, that you have violated these Terms or our Community Guidelines, we may take any of the following actions, with or without prior notice:

End your current session;
Temporarily or permanently ban your device, account, or both from the Service;
Remove or restrict access to specific features;
Report your conduct to law enforcement or other relevant authorities where legally required or otherwise appropriate.

5.4 You may report another user's conduct through the in-app reporting feature. We review reports but do not guarantee any particular outcome or timeframe for review.

5.5 We are not obligated to disclose the details, status, or outcome of any moderation action, report, or investigation, except where required by law.

5.6 Bans and reinstatement. Bans may be temporary or permanent. Where we mark a ban as appealable, we may offer reinstatement of the banned device for a one-time fee (currently US$10), available once per device. Paying the fee does not guarantee or entitle you to anything beyond lifting that ban, does not limit our right to ban you again, and is non-refundable except where required by law. Bans we mark as permanent (for example for conduct involving minors or other serious violations) cannot be bought out. If you are banned again after reinstatement, we may ban you permanently.

Note for counsel: confirm that charging a fee for reinstatement is acceptable under consumer-protection and crypto payment-processor rules in your target markets, and that the fee amount here matches the app.

6. Paid Plans, Prepaid Passes and Codes

6.1 Riyo offers optional paid tiers ("Plus," "Premium") as prepaid passes for a fixed period (for example 1, 3 or 12 months), and one-time purchases such as reinstating a banned device, as described on the Service at the time of purchase.

6.2 Payments are made in cryptocurrency through a crypto payment processor (currently BTCPay Server), or by redeeming a prepaid Riyo code. Passes do not renew automatically and we never charge you again without a new payment from you. We do not receive or store your wallet's private keys. Payment records (amount, invoice identifier, time, and the public transaction details) are kept as described in the Privacy Policy.

6.3 A pass runs until its end date and then your account returns to the free tier unless you add more time. Adding time to the same plan extends its end date. Except where required by law, payments and codes are non-refundable and cannot be exchanged for cash, including for unused time. Cryptocurrency payments cannot be reversed by us or by a card issuer.

6.4 Prepaid codes are redeemed once, by one account, and may expire or be cancelled if misused. Codes may be sold only by us or by resellers we have authorised; a code obtained from anyone else may be cancelled without refund. You must pay the exact amount and use the correct network shown on the payment page — we are not responsible for funds sent incorrectly or to the wrong address.

6.5 We may change prices or features with reasonable advance notice; a pass you have already paid for keeps the features it was bought with until it ends. Paid features that unlock filters (e.g., country or language matching) do not guarantee any particular match outcome, wait time, or match quality.

Note for counsel: confirm the crypto-payment, no-refund, prepaid-code and reseller terms against consumer-protection, tax and (where relevant) money-services rules in your target markets.

7. Intellectual Property

7.1 The Service, including its software, design, graphics, and trademarks, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as intended.

7.2 You retain ownership of content you generate during use of the Service (e.g., your video/audio feed, chat messages you send). By using the Service, you grant us a limited license to process, transmit, and temporarily store such content solely as necessary to operate, moderate, and secure the Service, as described in our Privacy Policy.

8. Disclaimers

8.1 You interact with other users at your own risk. We do not conduct background checks on users and cannot guarantee the identity, age, intentions, or behavior of anyone you are matched with.

8.2 THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

8.3 We do not warrant that content moderation will catch or prevent all instances of prohibited conduct.

8.4 Live chat translation is machine-generated by a third-party service and may be inaccurate. The text of messages you translate is sent to that service, as described in our Privacy Policy.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, [COMPANY LEGAL NAME] AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, OR FROM THE CONDUCT OF ANY OTHER USER, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) [JURISDICTION-APPROPRIATE MINIMUM AMOUNT].

Note for counsel: some jurisdictions restrict or prohibit liability caps and disclaimers of this kind, particularly for consumer contracts — this section needs jurisdiction-specific review.

10. Indemnification

11. Termination

11.1 You may stop using the Service and, where applicable, delete your account at any time.

11.2 We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of these Terms.

11.3 Sections that by their nature should survive termination (including Sections 5, 7–10, 13, and 14) will survive.

12. Governing Law and Dispute Resolution

13. Law Enforcement Requests

13.1 We may disclose information about you or your use of the Service in response to a valid subpoena, court order, or other lawful request from law enforcement or government authorities, or where we believe in good faith that disclosure is necessary to comply with the law, protect the safety of any person, or investigate suspected violations of these Terms.

13.3 If we become aware of apparent child sexual abuse material, we will act as described in Section 4.1.

14. Changes to These Terms
